Acceptance of the terms
To use the RegySurf Services, you must first accept the Terms. You should not use the Services if you do not accept the Terms.
You may accept the Terms by: clicking to accept or agree to the Terms, in the option made available to you by RegySurf in the user interface for any Service; or by effectively using the Services. In this case, you acknowledge and agree that RegySurf will take your use of the Services as an acceptance of the Terms from that moment onwards.
Provision of the RegySurf service
RegySurf is constantly innovating in order to offer the best experience to its users. You acknowledge and agree that the form and nature of the Services provided by RegySurf may change from time to time without prior notice.
Regarding this continuous innovation, you acknowledge and agree that RegySurf may, at its discretion, stop (permanently or temporarily) providing the Services (or any part of the Services) to you or to users generally, without prior notice. You may stop using the services at any time. You do not need to specifically inform RegySurf of the moment you stop using the Services. You acknowledge and agree that if RegySurf deactivates your account, you may be prevented from accessing the Services, your account data, or any files or other content in your account.
User obligations
The user undertakes to make appropriate use of the services and contents offered by RegySurf and not to use them to:
- Carry out unlawful activities or activities that constitute an offence, contrary to good faith, morality and public order, to accepted usage and customs, and/or that infringe the regulations on intellectual and industrial property, or any other rule of the applicable legal system;
- Disseminate content or propaganda of a racist, xenophobic or pornographic nature, that condones terrorism, or that violates human rights;
- Introduce or spread on the network data programs (viruses and harmful software) capable of causing damage to the computer systems of RegySurf, of its providers, or of third-party users of the Internet;
- Transmit to unauthorized third parties the username and passwords; and if your passwords come to the knowledge of an unauthorized user, you undertake to inform RegySurf immediately, which reserves the right to modify them for the protection of the service;
- Make available to all users, send by mail and/or in any way transmit, any content that, in accordance with the applicable provisions or existing contractual relations, the user is not authorized to transmit (such as inside information, information protected by industrial or intellectual property rights or information subject to confidentiality).
Likewise, users are expressly prohibited from reproducing, duplicating, copying, selling, reselling or exporting for commercial purposes any section of the service, or the use of or access to it.
Personal data - your name
You acknowledge and accept that your name may be displayed in several areas throughout the RegySurf application, in listings, ranking tables, and other places. Your name may be visible to any user of your box and, in some circumstances, to users of any box in the RegySurf community. If you register for activities through RegySurf, your name may be displayed publicly on screens and other information systems.
Image rights - your photo
You acknowledge and accept that if you add a photo to your profile, it may be displayed in several areas throughout the RegySurf application. Your photo may be visible to any user of your box and, in some circumstances, to users of any box in the RegySurf community. If you register for activities through RegySurf, your photo may be displayed publicly on screens and other information systems.
Your password and account security
You acknowledge and agree that you will be responsible for maintaining the confidentiality of the passwords associated with any account you use to access the Services. Consequently, you accept that you will be solely responsible to RegySurf for all activities that occur under your account. If you become aware of any unauthorized use of your password or your account, you agree to notify RegySurf immediately.
Limitation of liability
Certain information included in RegySurf is added by the managers of the boxes using the service. RegySurf is not responsible for the veracity of the contents or for any errors that may result from such information.
Within the RegySurf application there may be links to external sites, in respect of which RegySurf is not responsible for the technical availability of the web pages the user accesses through the APP.
The user assumes, under his/her sole responsibility, the damages or losses that may in any case derive from access to such contents, as well as any other damage or harm caused to his/her computer system by any material downloaded or in any way obtained through the use of the services, or any loss of data resulting from downloading such material.
Likewise, RegySurf shall not be liable for damages or losses arising from infringements by any user that affect the rights of another user, or of third parties, of copyright, trademarks, patents, confidential information and any other intellectual and industrial property rights.
RegySurf shall not be liable for damages and losses caused in case of impossibility of providing the services covered by these general conditions of use, in cases of force majeure, unforeseeable events and other causes not attributable to it.
RegySurf shall not be liable for (I) loss of information or data in the client's account, (II) damages caused by the fault of the Client or of third parties, (III) damages resulting from compliance with judicial decisions or decisions of administrative authorities, or (IV) damages resulting from the occurrence of cases of force majeure, that is, situations of an extraordinary or unforeseeable nature, external to RegySurf and beyond its control, such as fires, power outages, wars, riots, earthquakes, floods or other natural cataclysms, strikes or any other situations not controllable by RegySurf.
RegySurf does not guarantee that the Service will be uninterrupted and shall not be liable for any use, or inability to use, the Services, including, but not limited to, interruptions of the Service, problems in sending and receiving electronic messages (e-mails), Internet connectivity problems, unauthorized access to RegySurf servers, problems related to caching on DNS servers, and problems related to information transfer congestion on the Internet.
Nor shall RegySurf be liable for the inadequate use of the service as a consequence of maintenance work, of a defective configuration of the user's computer equipment, or of insufficient capacity to support the computer systems necessary for the use of the services offered.
Disclaimer of warranties
The services are provided “as is” and "as available", and RegySurf gives no express or implied warranty of any kind. In particular, RegySurf does not guarantee that:
- The use of the Services will meet your requirements;
- The use of the Services will be uninterrupted, timely, secure or free from errors;
- Any defects in the operation or functionality of any of the Services will be corrected.
No conditions, warranties or other terms (including any implied terms relating to satisfactory quality, fitness for purpose or conformity with the description) apply to the Services, except to the extent that they are expressly set out in the Terms. Nothing in the Terms shall affect the statutory rights to which you will always be entitled as a consumer and which, contractually, you cannot agree to assign or waive.
Intellectual and industrial property
All contents and elements that the user may access through the services offered by RegySurf are subject to industrial and intellectual property rights, patents, trademarks and copyright of RegySurf or of third-party holders thereof. Access to such contents or elements through the services provided by RegySurf does not grant the user any right of alteration, modification, exploitation or reproduction, distribution, public communication or any other right belonging to the holder of the right concerned.
The client/user undertakes to use the contents and/or elements accessed through the services offered by RegySurf for his/her own use and needs, and in no case to carry out a direct or indirect commercial exploitation thereof.
Failure to comply with the terms
RegySurf reserves the right to suspend the Service in the event of a breach by the Client of any of the obligations arising for the Client under this agreement.
Within the scope of the provision of the Service, RegySurf shall not be liable for losses of data/information that may result from the suspension of the Service in the event of a breach by the Client of any of the obligations arising for the Client under this agreement.
